Dashlark Terms of Service
Last updated: [DATE — set on publication]
These terms are an agreement between you and Helpy Media ("we", "us") about your use of Dashlark. By creating an account or connecting Dashlark to an AI agent, you accept them.
1. What Dashlark is — and what it is not
Dashlark connects your AI agent to real-world businesses so it can search, check availability, make bookings, and hand off purchases on your behalf.
We are an intermediary. We do not provide the services you book. The haircut, the dental appointment, the meal, the product — those come from independent businesses. Your relationship for the service itself is with them, on their terms and their cancellation policy.
We do not take payment. Where a purchase is involved, you complete it on the business's own website.
2. Your AI agent acts for you
This is the most important clause here, so it is written plainly.
When you connect Dashlark to an AI agent, you authorize that agent to act on your behalf. A booking your agent makes is a booking you made. A call your agent asks us to place is a call you asked for.
Every booking requires your explicit confirmation before it reaches the business. This is built into how Dashlark works, not just a request we make of your agent:
- Your agent asks us to book. We do not book. We prepare the booking and return a summary showing the business, address, service, date and time written out in full, price, the name and phone we will pass on, and the cancellation policy.
- Your agent shows you that summary. Nothing has been sent to the business.
- Only when you approve does your agent confirm, and only then do we contact the business.
If anything in the summary is wrong — the date, the number of people, the service — say so. Your agent discards it and prepares a corrected one. An unconfirmed booking simply expires.
What this means in practice:
- Read the summary before approving. It exists so mistakes are caught while they cost nothing.
- You are responsible for bookings made through your account, including ones you did not intend, unless someone accessed your account without authorization.
- We pass on what your agent sends us. If your agent supplies the wrong date and you approve it, we book that date. If we book something different from what you approved, that is our error — see section 8.1.
- Keep your agent connection secure. Anyone who can use your agent can use your Dashlark account through it.
If a booking is made in error, tell us and the business as soon as possible. We will help, but cancellation is the business's decision under their policy, not ours.
3. Calls we place for you
For businesses without a booking system, you can ask us to call them.
If you do:
- You authorize us to place that call and to speak on your behalf for that request only
- The call is made by an automated voice system, which identifies itself as such at the start
- We record and transcribe it so you have a record of what was agreed. We tell the other party.
- We will never provide payment information over the phone
- We confirm the details back to you before treating anything as booked
You can decline calls entirely and use only direct booking.
4. Your account
You must be at least 18. Provide accurate information — businesses rely on it. We verify your email and phone; bookings will not be sent to businesses without verification.
Keep your credentials secure and tell us promptly if your account is compromised.
5. Acceptable use
Do not:
- Make bookings you do not intend to honour, or use Dashlark to waste businesses' time
- Impersonate anyone, or book on someone's behalf without their agreement
- Attempt to extract our data in bulk, scrape the service, or reverse-engineer it
- Interfere with the service, or use it to break the law
- Use it to harass a business or its staff
Repeated no-shows may result in suspension. Businesses trusting agent-made bookings is what makes Dashlark work; abuse damages that for everyone.
6. Businesses listed on Dashlark
Some businesses are our partners. Others are listed from public information and have no relationship with us. A listing is not an endorsement, and we do not guarantee that information about any business is accurate, current, or complete.
If you are a business and want your listing changed or removed, contact us and we will act.
7. Availability
We are pre-launch and will change things. We may modify or discontinue features, and we do not promise uninterrupted service. Where a change materially affects you, we will give notice where we reasonably can.
8. Who is responsible for what
A booking made through Dashlark involves three parties — you (through your agent), us, and the business. Rather than disclaim everything, we set out below who is responsible for what, by the kind of thing that can go wrong.
8.1 What we are responsible for
We are responsible for our own errors. Specifically, we are responsible for:
- Transmitting your request accurately to the business — if your agent asks for Tuesday at 2pm and we book Wednesday, that is our error
- Recording bookings correctly — if we tell you something is booked, it should be booked
- Information we present about a business — its services, hours, and availability, to the extent this is within our control
- What our automated voice system says when it calls on your behalf. When we place a call, we are speaking, and we are responsible for what is said.
If we get one of these wrong, we will: correct it where we can, help you resolve it with the business, and reimburse direct out-of-pocket costs you incur as a result — for example a cancellation or no-show fee charged to you because of our error.
8.2 What you are responsible for
- The instructions you give your agent, and the accuracy of what you tell it. If you ask for the wrong date, we will book the wrong date.
- Confirming the details before committing. Agents can misunderstand; check the business, service, date and time before proceeding.
- Keeping access to your account and your agent secure.
8.3 What the business is responsible for
- The service itself — its quality, timeliness, and safety
- Honouring a booking we correctly transmitted
- Their own cancellation, deposit, and no-show policies
If a business cancels, does not honour a correct booking, or provides poor service, that is between you and them. We will tell you who to contact and give you the record of what was booked.
8.4 Limits on our liability
Except where section 8.1 applies, and to the extent the law allows:
- We are not liable for indirect or consequential loss
- Our total liability is limited to CAD $200
8.5 What these limits do not touch
Nothing in section 8.4 limits:
- Liability for bodily or moral injury — which cannot be excluded or limited under Quebec law
- Liability for gross or intentional fault
- Rights under Quebec's Consumer Protection Act or any other consumer-protection law that cannot be waived
If any limit in these terms conflicts with those rights, those rights apply and the limit does not.
9. Ending the agreement
You can close your account at any time — bookings already made stand. We may suspend or close your account for breach of these terms, with notice where practical.
10. Changes
We will notify you of material changes before they take effect. Continuing to use Dashlark after that means you accept them. If you do not, close your account.
11. Governing law
These terms are governed by the laws of Quebec and the applicable laws of Canada. Disputes go to the courts of Quebec, judicial district of Montréal.
Nothing here removes your right to bring a claim where consumer-protection law entitles you to, or to complain to a regulator.
